PREMISES LIABILITY - Anytime someone steps foot onto someone else's personal or commercial property, the property owner takes on considerable liability if that individual then becomes seriously injured or killed while on their property. The property owner must provide a "safe environment" to anyone that enters their premises.

What constitutes a "safe environment" can be interpreted many different ways. Recently, for example, a suit was filed when a customer was killed on a business's property by a person who was trying to rob the customer. The suit alleged that the retail business failed to provide adequate security and invited criminal activity. The jury later found for the plaintiff and awarded a 7-figure sum to the victim's family.

Most premises liablity cases result due to: serious slip and falls, falling objects, uneven surfaces, improper maintenance, broken steps, broken sidewalks, burns, fires and explosions, chemical exposure, dog bites, and swimming pool accidents. Usually these accidents take place at shopping malls, restaurants, hospitals, office buildings, personal residences, bars, nightclubs, parking garages, and other retail establishments.

The result of these accidents may be broken bones, spinal cord injuries, brain injuries, loss of limb, and even wrongful death. If the property owner is found to be negligent by providing an unsafe environment, and their negligence caused the injury, they can be held liable.
