PREMISES LIABILITY - Anytime someone steps foot onto someone else's personal or commercial property, the property owner takes on considerable liability if that individual then becomes seriously injured or killed while on their property. The property owner must provide a "safe environment" to anyone that enters their premises.
What constitutes a "safe environment" can be interpreted many different ways. Recently, for example, a suit was filed when a customer was killed on a business's property by a person who was trying to rob the customer. Usually these accidents take place at shopping malls, restaurants, hospitals, office buildings, personal residences, bars, nightclubs, parking garages, and other retail establishments.
The result of these accidents may be broken bones, spinal cord injuries, brain injuries, loss of limb, and even wrongful death. If the property owner is found to be negligent by providing an unsafe environment, and their negligence caused the injury, they can be held liable.
